yes we need to clarify the question.

Maybe a simplified "business" chain (or "value" or "pleasure") that is expressed in your post could help :
- software developer,
- software copyright owner,
- software downstream user.

In France, when you develop software for an employer who grants you a salary, you waive upfront all the rights to the employer.

Then, it is the employer's call to decide what would be the licensing terms for the downstream users, [whatever ]Open Source, copyrighted or public domain.( please note that software patenting is not possible under French regulation).
